This was a first home owner grant matter which was heard by the Victorian Civil and Administrative Tribunal. A decision was handed down on 6 February 2007 in favour of the Commissioner.
The issues were whether there was an eligible transaction under section 13 of the First Home Owner Grant Act 2000 and also whether pursuant to section 15 all interested persons have joined in the application for the grant.
