Apply for a duty refund
Request a refund when duty has been overpaid.
Background information
You can apply for a duty refund if you paid too much duty on a property transfer.
This can happen if you did not claim an exemption, concession or reduction you were eligible for at the time of transfer.
You can apply for a refund up to 5 years after the duty was paid.
Step 1: Gather required information
You need the following information to complete the Duties Refund SmartForm. Refer to the form for specific instructions.
- Full contact details for all transferees registered on title, including individuals, trusts or companies.
- Title details (refer to the certificate of title, plan of the property, transfer of land documentation, and council rate notice).
- Transaction details.
- Documents that prove your eligibility for a refund.
- Bank account details for the refund.

Step 3: Lodge the form
Scan your application and lodge it via the correct channel:
- Organisations must lodge the application and all attachments via Duties Online.
- Individuals must lodge the application and all attachments via our public lodgement system.
We do not accept paper-based submissions.
Next steps
Allow up to 60 days for a decision on your refund application.
If we approve your refund, we will deposit the amount into your nominated bank account.
If you have a tax debt with us, we will use the refund amount to offset that debt and pay any remaining amount into your nominated bank account.
